Terms of Service

1. Acceptance of Terms

By accessing or using LMT Assistant ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

LMT Assistant is a practice management application designed for licensed massage therapists. The App provides tools for:

Client management, scheduling, and recurring appointments
Session timing and SOAP note documentation
Invoicing with PDF preview and email delivery
Expense tracking with AI-powered receipt scanning
Income and 1099 tracking with AI document scanning
Mileage logging with Google Maps distance calculation and AI booking screenshot scanning
Credentials vault for licenses, insurance, CE certifications, and transcripts with AI document scanning
State continuing education requirements for all 50 US states
Professional goals tracking
Booking link generation
Therapist network for professional contacts and referrals
Encrypted data backup and restore
Push notifications for credential renewal reminders
Optional integrations (Spotify for session music)

3. Account Registration

To use the App, you must:

Be at least 18 years old
Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access

4. User Responsibilities

You are responsible for:

All activity that occurs under your account
Ensuring your use complies with applicable laws and regulations
Maintaining appropriate licenses for your profession
Obtaining necessary consents from clients before storing their information
Obtaining permission from other therapists before sharing their contact information via the Therapist Network feature
Regularly backing up your important data using the App's export feature
Keeping your encryption keys secure and not sharing account credentials
Reviewing AI-extracted data for accuracy before saving (AI scanning is provided for convenience and may contain errors)

5. Subscriptions and Payment

The App offers a free tier with essential features and advertisements. A Pro subscription is available that unlocks all features and removes ads. Subscriptions are managed through Apple's App Store or Google Play Store via RevenueCat. By subscribing, you also agree to the terms of the applicable app store.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
You can manage or cancel your subscription through your device's app store settings
Refunds are handled by Apple or Google according to their respective refund policies

6. AI-Powered Document Processing

The App uses artificial intelligence services to extract data from photos and documents you upload (receipts, 1099 forms, credentials, insurance documents, and booking screenshots). By using these scanning features, you acknowledge and agree that:

Images you scan are transmitted to third-party AI services for text extraction (see Section 8 for a list of services)
Images may be converted from HEIC to JPEG format before transmission for compatibility
AI-extracted data is provided for convenience and may contain inaccuracies. You are responsible for verifying all extracted information before saving
You should not scan documents containing information you do not wish to be processed by third-party AI services
Images are processed for the sole purpose of text extraction and are not stored by these services beyond the processing request

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy. Key points:

All Protected Health Information (PHI) is encrypted using AES-256-CBC encryption
The App supports offline functionality; data queued offline is encrypted and synced when connectivity is restored
You are responsible for complying with HIPAA and other applicable regulations regarding client health information
Exported backup files are encrypted and should be stored securely
Past appointments cannot be edited to maintain data integrity

8. Third-Party Integrations

The App integrates with the following third-party services:

OpenAI (GPT-4o Vision): For AI-powered scanning of receipts, credentials, tax documents, insurance documents, and booking screenshots
AWS Textract: For OCR processing of tax forms (fallback service)
Mindee: For receipt parsing (fallback service)
Google Cloud Vision: For document OCR (fallback service)
Google Maps, Places, and Directions APIs: For mileage calculation, address lookup, and distance estimation
RevenueCat: For subscription management via Apple App Store and Google Play
Google AdMob: For displaying advertisements in the free tier
Supabase: For database, authentication, and file storage
Sentry: For anonymous crash reporting and error tracking
Spotify: For optional music integration during sessions (requires separate authorization)
Apple and Google Sign-In: For optional authentication
Expo Push Notifications: For credential renewal reminders and appointment alerts

Each third-party service has its own terms of service and privacy policy. Optional integrations (Spotify, sign-in providers) can be enabled or disabled at any time.

9. Referral Program

The App may offer referral codes that provide benefits to new users. Referral codes are subject to availability and may be modified or discontinued at any time. Abuse of the referral system may result in account suspension.

10. Intellectual Property

The App and its content are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our written permission.

11. Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP. AI-POWERED SCANNING FEATURES ARE PROVIDED FOR CONVENIENCE AND WE MAKE NO WARRANTY AS TO THE ACCURACY OF EXTRACTED DATA.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these terms. You may delete your account at any time through the App settings. Upon termination, your subscription will not be renewed but no partial refunds will be issued for the current billing period.

13. Changes to Terms

We may modify these terms at any time. Continued use of the App after changes constitutes acceptance of the new terms.

14. Governing Law

These terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.
