Acceptance of Terms

By accessing or using LMT Assistant ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

Description of Service

LMT Assistant is a practice management application designed for licensed massage therapists. The App provides tools for:

• Client management, scheduling, and recurring appointments
• Session timing and SOAP note documentation
• Invoicing with PDF preview and email delivery
• Expense tracking with AI-powered receipt and PDF scanning
• Income and 1099 tracking with AI document scanning
• Mileage logging with Google Maps distance calculation and AI booking screenshot scanning
• Credentials vault for licenses, insurance, CE certifications, and transcripts with AI document scanning
• State continuing education requirements for all 50 US states
• Professional goals tracking
• Online booking: a shareable, client-facing booking link with studio and mobile visit options, travel-fee disclosure, intake and consent fields, and therapist-side approval with automatic SMS confirmation
• Therapist network for professional contacts and referrals
• Encrypted data backup and restore
• Push notifications for appointment reminders, incoming booking requests, and credential renewal alerts
• Optional integrations (Spotify for session music)

Account Registration

To use the App, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

User Responsibilities

You are responsible for:

• All activity that occurs under your account
• Ensuring your use complies with applicable laws and regulations
• Maintaining appropriate licenses for your profession
• Obtaining necessary consents from clients before storing their information, including clients who submit bookings through your client-facing booking link
• Providing your own privacy and consent disclosures on your client-facing booking page
• Obtaining permission from other therapists before sharing their contact information via the Therapist Network feature
• Regularly backing up your important data using the App's export feature
• Keeping your encryption keys secure and not sharing account credentials
• Reviewing AI-extracted data for accuracy before saving (AI scanning is provided for convenience and may contain errors)

Subscriptions and Payment

The App offers a free tier with essential features and advertisements. A Pro subscription is available that unlocks all features and removes ads. Subscriptions are managed through Apple's App Store or Google Play Store via RevenueCat. By subscribing, you also agree to the terms of the applicable app store.

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription through your device's app store settings
• Refunds are handled by Apple or Google according to their respective refund policies

AI-Powered Document Processing

The App uses artificial intelligence services to extract data from images and PDFs you upload (receipts, 1099 forms, credentials, insurance documents, and booking screenshots). By using these scanning features, you acknowledge and agree that:

• Images and PDFs you scan are transmitted through our server-side edge function to OpenAI (see Section 8 for details)
• Images may be converted from HEIC to JPEG before transmission for compatibility
• AI-extracted data is provided for convenience and may contain inaccuracies. You are responsible for verifying all extracted information before saving
• You should not scan documents containing information you do not wish to be processed by third-party AI services
• Images and PDFs are processed for the sole purpose of text extraction and are not stored by these services beyond the processing request

Online Booking and Client-Facing Pages

The App allows you to generate a shareable booking link your clients can use to request appointments. When you use this feature:

• You are the controller of any personal information your clients submit through your booking page
• You must provide any privacy disclosures, intake consents, and client-facing notices required by applicable law on your booking page
• When you approve a pending booking, an automatic SMS confirmation is sent to the client's submitted phone number using a third-party SMS provider
• Travel fees, studio vs. mobile location options, services, and availability shown on the booking page are configured by you from within the App

Data and Privacy

Your use of the App is also governed by our Privacy Policy. Key points:

• All Protected Health Information (PHI) is encrypted using AES-256-CBC encryption
• The App supports offline functionality; data queued offline is encrypted and synced when connectivity is restored
• You are responsible for complying with HIPAA and other applicable regulations regarding client health information
• Exported backup files are encrypted and should be stored securely
• Past appointments cannot be edited to maintain data integrity

Third-Party Integrations

The App integrates with the following third-party services:

• OpenAI (Responses API, GPT-4o vision): AI-powered scanning of receipts, credentials, tax documents, insurance documents, PDFs, and booking screenshots
• Google Maps, Places, and Directions APIs: Mileage calculation, address lookup, and distance estimation
• RevenueCat: Subscription management via Apple App Store and Google Play
• Google AdMob: Displaying advertisements in the free tier
• Supabase: Database, authentication, file storage, and serverless edge functions
• Sentry: Anonymous crash reporting and error tracking
• Spotify: Optional music integration during sessions (opens externally; requires separate authorization)
• Apple and Google Sign-In: Optional authentication
• Expo Push Notifications: Appointment reminders, booking request alerts, and credential renewal reminders
• SMS delivery providers: Sending booking confirmation texts to clients when you approve a booking request

Each third-party service has its own terms of service and privacy policy. Optional integrations (Spotify, sign-in providers) can be enabled or disabled at any time.

Referral Program

The App may offer referral codes that provide subscription discounts to new users. Referral codes are subject to availability and may be modified or discontinued at any time. When you enter a referral code, it is linked to your account and recorded for promotional tracking purposes. Each user may redeem one referral code. Referral code creators may receive aggregated, anonymized data about the number of redemptions but never receive personally identifiable information about users who redeemed their code. Abuse of the referral system may result in account suspension.

Account Authentication

We send secure, one-time links to your email for account verification and password resets. These links expire after a short period and redirect you to the App. You are responsible for keeping these links private and not sharing them with others. If you believe your account has been compromised, contact us immediately.

Intellectual Property

The App and its content are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our written permission.

Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP. AI-POWERED SCANNING FEATURES ARE PROVIDED FOR CONVENIENCE AND WE MAKE NO WARRANTY AS TO THE ACCURACY OF EXTRACTED DATA.

Termination

We may suspend or terminate your access to the App at any time for violation of these terms. You may delete your account at any time through the App settings. Upon termination, your subscription will not be renewed but no partial refunds will be issued for the current billing period.

Changes to Terms

We may modify these terms at any time. Continued use of the App after changes constitutes acceptance of the new terms.

Governing Law

These terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.
